General Policies
Payment: Scope of work is an estimate, based on Client’s suggested quantities. Final pricing will reflect final totals, using the same unit pricing as outlined in estimate. Client agrees to pay LEMD in accordance with the terms specified in this proposal (Scope of Work). Payment is due, in full, upon completion of the project, prior to the finished product being shipped to the Client, regardless of contracted completion date. If Scope of Work decreases, due to factors including, but not limited to, reduced quantity, change of material/print method, and/or adjusted services rendered, Client is responsible for payment of 75% of originally-contracted total price, as outlined in Scope of Work. Payment may be applied toward event-related items or used separately, to be paid within one year of event date.

Copyright: All designs, images, works of art, and/or products sold from this website or direct from provider remain the sole property and copyright of LEMD. Client does not have the right to print or produce items independently using any of this material. This includes, but is not limited to, any stationery items to be used on the date of the event (menus, ceremony programs, etc). The limited use granted to Client are for designs in their original, complete form only; these pieces may not be altered or edited for derivative usage.

License for Limited Usage: Upon completion of the project and full payment, LEMD grants Client limited usage rights of final works only as outlined in Scope of Work section. Any additional usage requires additional pricing, including, but not limited to: a) printing services rendered by LEMD (with no added licensing fee); or for b) Client’s purchase of an extended license of design(s) to print or produce items independently. The rights granted to Client are for usage of custom designs in their original form only; these pieces may not be altered or edited for derivative usage.

Sharing Work Publicly: Client grants LEMD permission to use the project (completed or as works in progress) publicly in a photograph, video, or other digital media (“photo”) in any and all of its publications, including but not limited to website, social media, blogs, or marketing collateral, without payment or other consideration. LEMD will respect privacy of Client and Client’s gift recipient(s), without divulging sensitive information, such as residential addresses or related private information. LEMD will not share completed, final project in its entirety publicly until Client and Client’s recipient(s) have seen it first privately. If the project should NOT be shared publicly in any capacity, Client will provide separate written notice to LEMD of this privacy request, within 48 hours of signing this contract.

Safe and Respectful Environment: The parties agree to cooperation in maintaining a physically and emotionally safe environment, including an environment free of inappropriate behavior toward LEMD staff. Inappropriate behavior includes but is not limited to physical or verbal harassment, threatening, hostile, offensive, sexual or lewd behavior from Client or any associated party, or disregard of governmental and/or health professional safety guidelines. If such conduct occurs at any time, LEMD reserves the right, in LEMD’s sole discretion, to terminate services without refund or waiving the right to full payment under this agreement.

Refunds and Payment Responsibility
Payment responsibility in the instance of LEMD lack of availability: If LEMD is not available for project as booked to be finished by requested completion date, a full refund will be given if requested. If LEMD is available and moves forward with Client’s project, no refunds will be given. See below.

Payment responsibility in the instance of Client-driven cancellation: Should Client choose to cancel order, there shall be no refunds for payments already received by LEMD. Upon Client approval of the Final Proof, Client is responsible for the entirety of that phase of production/printing cost, even in the instance of cancellation of the event. If the event is cancelled prior to final proof approval/printing, the paid retainer is non-refundable. The balance will not be due and no work will be completed; Client will sign cancellation contract addendum and will be removed from production calendar.

Payment responsibility in the instance of Force Majeure: Neither Client nor LEMD will be liable or have the right to terminate this Agreement for any delay or default in performing services if caused by conditions beyond control including, but not limited to, acts of God (such as hurricanes, earthquakes, flooding), fire, epidemics, Government restrictions, wars, terrorist acts, insurrections and/or any other cause beyond the reasonable control of the party whose performance is affected. If service is impacted as a result of a force majeure event, there shall be no refunds for payments already received by LEMD, but LEMD will use all reasonable efforts to work with Client to rectify the situation in an efficient manner, subject to availability, as needed on a case by case basis. Additional fees may be incurred for these items.

Custom Design Services – Wedding Stationery
Content Accuracy: Client is responsible for proofing the accuracy of all custom work, including, but not limited to, times, dates, and spelling of words, names, and places, as well as the design elements. Upon Client’s approval of final proof, LEMD reserves the right to print as it appears and will not be held responsible for errors found after Client’s approval of the final proof.

Included Revisions, Client Responsibility, Completion Date: Two rounds of revisions (first draft, revised draft, second revised draft if needed) are included in the Scope of Work. Any additional rounds of revisions are subject to an additional $75.00 minimum design fee, along with any changes in materials and/or productions costs. Client is expected to approve/request changes within 48 hours, upon receipt of proofs. Added revision rounds and/or slow response times from Client will delay the process, which could cause a rush production time for design, printing, or calligraphy work. If the Scope of Work can still be completed within that shortened window of time, that portion will be subject to rush production fees, as outlined in the following section. If the work can’t be accommodated in the reduced time and causes push-back in timeline, the Client understands that the work will be moved to the first available slot in LEMD’s production calendar, which could be past the contracted completion date.

Revisions vs. Overhauls: Revisions represent small modifications to overall proof. A complete design overhaul constitutes Client-requested major change(s) to the design, including, but not limited to, different foundational base design chosen, calligraphy style, or custom artwork involved. This requires LEMD to start the Client’s design over or recreate a large portion of custom work. At LEMD’s discretion, an overhaul is subject to an additional $250.00 minimum design fee.

Calligraphy and Artistic Services
Production time and rush fees: LEMD’s standard production time for an artistic project is two weeks. Wedding stationery timelines will vary and will be supplied to Client separately. A Client requiring an art commission order to be completed in 10 or fewer days will be charged an additional rush fee, calculated as a minimum of 25% of the order subtotal. Rush shipping fees will also be higher than normal, which the Client will be subject to pay.

Overage requirements for envelope calligraphy: Please provide 15% extra blank pieces above what will be required to complete, if you are not ordering your materials through LEMD. Calligraphy is a handmade art form and errors happen. Client will receive any unused products upon completion.

Return of rented items: Client is responsible for returning any rented pieces to LEMD by the date outlined on the first page, in the same condition it was provided. Items that are damaged, missing, or broken are subject to an additional replacement fee, calculated as three times the rental rate outlined on the Scope of Work (per piece).

Address Lists: Please format your addresses utilizing the LEMD template, which will be provided. Everything should be fully spelled out, without abbreviations. Re-formatting a list is subject to an additional $75.00 fee. LEMD will write out/print names and addresses exactly as provided and is not responsible for any Client errors in spelling or etiquette. If you have questions about etiquette for mailing, please ask!

Additional Calligraphy Pieces: For any additional pieces to be produced after order has been completed, items will be billed with a $35.00 base rate, plus the cost of the individual item(s) to be produced. This includes, but is not limited to, “B-List” invited guests, changes in address, or USPS loss.

Artistic quality and style: The nature of hand lettering means that each piece is a unique, custom work of art. Therefore, slight variances will occur. Each unit will vary from the other pieces, which is their purpose as individual works of art. The LEMD style is evident throughout website and other marketing platforms. Client understands general style, which will be adhered to, unless otherwise discussed.

Delivery through the mail: LEMD guarantees that the order is sent on time to Client and that each piece is legible. LEMD is not responsible for any individual items lost or returned to sender through the United States Postal Service and not received by the ultimate intended recipients. As with any mass mailing, expect a small percentage to be undelivered. Client has the option to pay for any pieces to be re-done for re-mailing, as outlined above.

Shipping: LEMD guarantees that Client’s order is sent on time to Client via UPS from metro Detroit, Michigan. Shipping time varies, and is often 2-7 business days, but not guaranteed. LEMD is not responsible for the package getting lost, mishandled, damaged, or returned to sender through the shipping process. All pieces will be unassembled, in individual bundles by piece. It is the Client’s responsibility to assemble the suite, unless otherwise indicated in Scope of Work.
